1. About these terms

These terms are an agreement between you and Gloath Limited, a company registered in New Zealand ("Gloath", "we", "us"), about your use of ai.gloath.com (the site), Gloath's apps, and the AI models you use on them. By creating an account or using the site, you agree to them. If you use the site for an organisation, you agree to them on its behalf and confirm you're allowed to.

2. The service

The site lets you chat with Gloath's AI models. Some run in your web browser, on your own device; others may run on Gloath's servers, and the model menu says which. The site is free to use, and Gloath Pro (section 4) is an optional paid subscription. The service is an early research preview: we may change, pause or stop it, or any part of it, at any time. If we stop Gloath Pro, section 4 explains what happens.

3. Your account

• You must be 16 or older to create an account.
• Give accurate details and keep your password to yourself. You're responsible for what happens on your account.
• An account is for one person.
• We may suspend or close an account, or limit what it can do, if it breaks these terms, if the law requires us to, or to protect the site or other people. We'll tell you why unless the law doesn't allow it or it would put someone at risk.
• You can delete your account at any time in Settings.

4. Gloath Pro

• What you get. Gloath Pro keeps all your chats, backs them up so they're on every device you sign in on, lets you choose whether your new chats help train Gloath's models, and gives you new Gloath models and features before everyone else, as described on the Gloath Pro page. Backup space is up to 1 GB. We may improve Pro or change what it includes; if a change takes something important away, we'll tell you first, and you can cancel.
• Price and renewal. Pro costs the price shown when you subscribe, monthly or yearly, in New Zealand dollars, including GST where it applies. Depending on where you live, other taxes may be added at checkout. It renews automatically at the end of each period, and Stripe charges your card then, until you cancel.
• Cancelling. You can cancel at any time in Settings, under Plan. Pro carries on until the end of the period you've paid for, and you won't be charged again. We don't refund part periods, except where the law requires us to.
• Price changes. If we change the price, we'll email you at least 30 days before it applies to you. The new price starts at your next renewal after that, and you can cancel before then.
• Payments that fail. If a payment doesn't go through, Stripe tries again for a while. If it still can't be made, Pro ends.
• When Pro ends. Your chats stay on your devices, and your backup is kept as the privacy policy explains, so you can download it, delete it, or pick up where you left off if you come back.
• If we stop offering Pro, or close your account for reasons that aren't your fault, we'll refund the part of your current period you haven't used.
• Fair use. We don't limit how many messages Pro members send. If an account's use puts the service at risk for everyone, for example through automated scraping, we may limit it, and we'll tell you.

5. What AI models can and can't do

Seddon and our other models generate text by predicting likely words. Their replies can be wrong, incomplete, out of date, biased or offensive, and they can sound confident when they're wrong.

• Don't rely on them for medical, legal, financial, safety or other professional advice, or for decisions that significantly affect anyone.
• Check anything important against a reliable source.
• Test any code they write before you use it: it can have bugs and security problems.
• The replies don't represent Gloath's views.

6. Using the site responsibly

Don't use the site or our models to:

• break any law, or help anyone else to
• harm, harass, threaten, deceive or exploit people
• create or share sexual content involving anyone under 18
• impersonate people or organisations, or spread deliberately false information
• create malware, or attack or break into computer systems
• infringe anyone's intellectual property or privacy

Don't try to interfere with the site: for example by overloading it, getting around sign-in, payment or security measures, or collecting information about other users. Don't try to copy, extract or work out the inner workings of models that run on Gloath's servers, or use their replies to build or train a competing model.

7. Your messages and the replies

You own what you write, and we claim no ownership of the replies. You let Gloath store, copy and use your chats (your messages, the replies and the ratings you give them) to provide the site, including backup and models that run on Gloath's servers, and to develop, train and improve Gloath's models and services, as our privacy policy describes. This licence is worldwide and free of charge, and Gloath may keep using what it has learned from your chats after your account ends. On Gloath Pro you can stop your new chats being used for training, in Settings.

Don't put anything in a chat that you don't have the right to share, or that you wouldn't want used this way, such as passwords, or someone else's personal details. You're responsible for what you type and for how you use the replies. Replies aren't unique: other people may get similar ones, and they may resemble existing works, so check your rights before publishing them.

8. Our models, site and names

• Models we release openly are licensed under their own licences, shown on the licences page. Seddon 1.1 is licensed under the Apache License 2.0.
• Models that run on Gloath's servers, and everything else on the site, including its design, text and software (such as the engine that runs models in your browser), belong to Gloath Limited. You may use them to use the site, but not copy, change or redistribute them without our permission, except where the law allows.
• "Gloath", "GloathAI" and "Seddon", and our logos, are our trade marks. Don't use them in a way that suggests we endorse or are connected with you.

9. Your device and data

Downloading a model uses your internet connection: Seddon 1.1 is about 140 MB, and any data charges are yours. Running it uses your device's processor or graphics card, memory and battery, and works best on a reasonably recent computer.

10. Other services

Signing in with Google, payments through Stripe, and downloads from Hugging Face are provided by those companies under their own terms.

11. Privacy, and when we may act on information

Our privacy policy explains what we collect and how we use it, including when we may look at or disclose information: when you ask us to, when the law requires it, to keep people safe, or to deal with serious misuse of the site. It also explains when we may have to keep information, even if you ask us to delete it.

12. Feedback

If you send us ideas or suggestions, we may use them without owing you anything.

13. No guarantees

The site and the models are provided "as is" and "as available". To the extent the law allows, we make no promises that they'll be accurate, available, secure or suitable for any purpose, or that backups will never be lost, so keep copies of anything important (Settings, under Data, has "Download my chats").

Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other laws that can't be excluded. If you use the site for business, you agree that the Consumer Guarantees Act doesn't apply and that this is fair and reasonable.

14. Our liability

To the extent the law allows, we aren't liable for any indirect or consequential loss, or for loss of data, profits or opportunity, arising from the site or the models, however caused. To the extent the law allows, our total liability to you is limited to the greater of NZ$100 and what you've paid us in the 12 months before the claim.

15. Changes and ending

We may update these terms. If a change is significant, we'll tell you by email or on the site, and ask you to read and agree to the new terms the next time you sign in. Changes to the price of Gloath Pro follow section 4. You can stop using the site and delete your account at any time. Sections 7, 8, 13, 14 and 16 continue to apply after your account ends.

16. Law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction over any dispute about them.
